Terms of Service

These terms are a working draft and are subject to solicitor review before Willful accepts real users or payments.

1. About Willful

Willful UK Ltd (“Willful”, “we”, “us”, “our”) operates willful.uk, an online platform that enables users to create a draft will through a guided interview process, which is then reviewed and approved by a qualified UK solicitor.

Willful is applying for authorisation as an Alternative Business Structure (ABS) under the Legal Services Act 2007, regulated by the Solicitors Regulation Authority (SRA). Until such authorisation is granted, the solicitors providing review services operate under their individual SRA registration.

2. The service we provide

Willful provides:

  • A guided interview to collect your wishes and personal circumstances
  • An AI-assisted draft will prepared from your responses
  • Professional review and approval by a qualified UK solicitor
  • A secure vault for storing important documents
  • Family access controls to share your will with trusted people

We do not provide legal advice. Our AI and interview system collect information and help structure your wishes — they do not advise you on the legal effect of your decisions. Our solicitors review your completed will for legal validity and may ask clarifying questions, but cannot advise you on estate planning strategy or tax planning.

If you require legal advice about your estate, you should consult an independent solicitor.

3. Eligibility

To use Willful, you must:

  • Be at least 18 years old
  • Be ordinarily resident in England or Wales
  • Have testamentary capacity — you must be of sound mind, understand the nature of a will, know the extent of your estate, and be free from undue influence
  • Have a UK bank account or payment card for the service fee

Willful does not currently support wills governed by Scottish, Northern Irish, or non-UK law.

4. Testamentary capacity

By completing the capacity confirmation step of the interview, you confirm that at the time of making your will you have testamentary capacity as defined by Banks v Goodfellow [1870]. Our solicitors will review your capacity statements as part of their approval process.

If there are concerns about capacity, our solicitors may request additional information, recommend a capacity assessment, or decline to approve your will.

5. Fees and payment

Our fees are displayed on our Pricing page before you begin the interview. Fees are charged in pounds sterling and are inclusive of VAT where applicable. Payment is processed securely by Stripe.

Fees are due before your will is released for signing. If our solicitor cannot approve your will (for example, due to capacity concerns), we will offer a full refund.

6. Execution of your will

A will created through Willful must be executed (signed) in accordance with section 9 of the Wills Act 1837:

  • Signed by you (or by someone in your presence and at your direction)
  • In the presence of two witnesses who are both present at the same time
  • Each witness must sign or acknowledge their signature in your presence
  • Witnesses must not be beneficiaries or spouses/civil partners of beneficiaries

Willful provides signing guidance but is not responsible for errors in execution. An improperly executed will may be invalid.

7. Limitation of liability

To the fullest extent permitted by law, Willful's aggregate liability for any claim arising from use of the service is limited to the amount you paid for the service in the 12 months preceding the claim.

We are not liable for: the decisions you make in your will; the validity of your will if it is not properly executed; changes in law after your will is created; or any loss arising from your failure to update your will following a change in your circumstances (such as marriage, divorce, or the birth of a child — all of which may affect your will).

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law.

8. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
